Welcome to EXGC solutions (D.B.A) Everything Gutters. By accessing our website or scheduling any gutter‑related services, you agree to the following Terms & Conditions. Please read them carefully, as they outline your rights and responsibilities under California law.
The Everything Gutters Company provides gutter installation, repair, cleaning, and maintenance services throughout California.
We provide services as described in your written estimate, invoice, or service agreement. Services may include:
Gutter installation or replacement
Gutter repair
Gutter cleaning
Downspout installation or repair
Leaf guard installation
Related exterior water‑management services
Any work not listed in the original estimate will be considered additional and may incur extra charges.
We comply with all relevant California laws, including:
3.1 Right to Cancel (California Home Solicitation Sales Act)
If your contract is signed at your home (not online or at our office), California law gives you three business days to cancel without penalty. You will receive a written Notice of Cancellation with your contract.
3.2 Written Contract Requirements
For projects over $500, California law requires:
A written contract
Our business name, address, and license number
A description of the work
Total contract price
Approximate start and completion dates
We provide all required documentation before work begins.
3.3 Deposits
California law limits deposits for home improvement work to no more than 10% of the contract price or $1,000, whichever is less.
4. Estimates & Pricing
Estimates are valid for 30 days unless otherwise stated.
Pricing may change if hidden damage is discovered (e.g., rotted fascia, structural issues, pest damage).
Any changes will be documented in a written change order, as required by California law.
5. Payment Terms
Payment is due upon completion unless otherwise agreed in writing.
Accepted payment methods: cash, check, Zelle.
Late payments may incur fees as permitted by California law.
Returned checks may result in additional charges.
6. Client Responsibilities
To ensure safe and efficient service, the Client agrees to:
Provide clear access to gutters, downspouts, and work areas
Secure pets and personal property
Notify us of known hazards (e.g., weak roofing, electrical issues, unstable soil)
We are not responsible for damage to items left in or near the work zone.
7.1 Workmanship Warranty
We provide a workmanship warranty of 1 year on new gutter installations. This warranty does not cover:
Damage caused by storms, debris, or natural disasters
Improper maintenance
Alterations by third parties
Structural issues unrelated to the gutter system
7.2 Manufacturer Warranties
Material warranties are provided by the manufacturer and are subject to their terms.
7.3 California Warranty Disclosure
California law requires that all warranties be provided in writing. You will receive a written warranty document at the completion of your project.
8. Limitations of Liability
To the fullest extent permitted by California law:
We are not responsible for pre‑existing damage or structural defects.
We are not liable for water intrusion, foundation issues, or roof damage caused by factors outside the gutter system.
Our total liability shall not exceed the amount paid for the services provided.
9. Scheduling, Cancellations & Weather Delays
Clients may cancel or reschedule with 24 hours’ notice.
Cancellations with less notice will incur a service fee.
We may reschedule due to unsafe weather conditions, including rain, wind, or extreme heat.
10. Property Conditions & Landscaping
While we take reasonable care, gutter work may involve ladders, tools, and equipment that can temporarily impact landscaping or exterior surfaces. Minor cosmetic disturbances are not considered damage.
11. Safety Requirements
For everyone’s safety:
Clients and bystanders must maintain distance from the work area
We follow OSHA and California safety regulations
We may pause work if unsafe conditions arise
12. Photos & Media
We may take before‑and‑after photos for documentation. We will request your consent before using any images of your property for marketing purposes, in compliance with California privacy laws.
13. Website Use Terms
By using our website, you agree to:
Not misuse or attempt to disrupt the site
Not copy or distribute website content without permission
